On 5 March 2026, the United States Court for the District of Arizona denied Discount Tire’s motion to dismiss in McGreathy v Reinalt-Thomas Corp. et al. – an outcome that moves the case towards trial. The case, which is defined as an ERISA class action, was filed by Sanford Heisler Sharp McKnight in April 2025 alleging “mismanagement for failure to remove the American Century Target Date Funds after over 10 years of underperformance relative to comparable target date funds”. ERISA refers to the Employee Retirement Income Security Act of 1974, which establishes protections for most voluntarily established employee benefit plans in private industry.
